Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Walking Trails website and the Walking Trails mobile application (the "Service") operated by iLife BV ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Liability Disclaimer

Walking Trails is a navigation aid designed for recreational hiking and cycling. Use of the application and execution of routes is entirely at your own risk.

  • Physical Condition: You are responsible for ensuring you are in sufficient physical condition to undertake any route suggested by the application.
  • Environment: Nature and road conditions can change rapidly. The route displayed on the map may differ from reality due to weather, construction, or other factors.
  • No Warranty: iLife BV does not guarantee that the routes are free of obstacles, safe, or suitable for your specific skill level.

2. Priority of Signage

Real-world signage and traffic rules ALWAYS take precedence over the application's instructions.

In the event of a discrepancy between the route displayed in the application and the local situation (e.g., road signs, traffic lights, temporary diversions, or physical barriers), you must strictly adhere to the local situation and traffic regulations. iLife BV is not liable for fines, accidents, or damages resulting from ignoring local traffic rules or signage.

3. Data Accuracy

Our maps and route data utilize the OpenStreetMap (OSM) project and other open data sources.

  • This data is provided "as is" and "as available" without any warranty of any kind, express or implied.
  • We do not guarantee the accuracy, completeness, or timeliness of map data, route calculations, or distance estimates.
  • Errors in map data (e.g., missing paths, incorrect classifications) are not the liability of iLife BV.

4. Intellectual Property & User Content

Service Content: The Service and its original content (excluding user-generated content and OpenStreetMap data), features, and functionality are and will remain the exclusive property of iLife BV and its licensors.

User Content: by submitting routes, photos, or other content to the Service, you grant iLife BV a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.

5. Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by iLife BV.

iLife BV has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that iLife BV shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

Any dispute arising from or related to the use of the Service shall be subject to the exclusive jurisdiction of the courts of Hasselt, Belgium.

7. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
